Pathway 1: Absolute Discharge
Discharge: 730 ILCS 5/5-2-4(a)
As provided in the statute:
“If the Court finds the person not in need of mental health services, then the Court shall order the defendant discharged from custody.” 730 ILCS 5/5-2-4(a).
In these cases, the individual is released from custody and is no longer subject to court supervision or IDHS monitoring. Before discharge, the court shall order the facility director to establish a discharge plan that addresses the individual’s shelter, support, and medication needs, and may include self-medication training when appropriate.
